1MDB: PAS puas hati selepas jumpa Arul Kanda



PAS hari ini berkata mereka berpuas hati selepas mendengar penjelasan mengenai hutang yang ditanggung 1MDB dan pelan rasionalisasi hutang itu dari presiden 1MDB sendiri, Arul Kanda Kandasamy.

Arul Kanda memberikan penerangan kira-kira 2 jam kepada Timbalan Presiden Datuk Tuan Ibrahim Tuan Man dan hampir 30 ahli Jawatankuasa Kerja PAS Pusat, serta tokoh jemputan seperti bekas menteri besar Selangor Tan Sri Khalid Ibrahim.
Sidang meja bulat itu diadakan di Hotel de Palma, Ampang pada jam 9.00 pagi tadi.

“Secara keseluruhan bagi pihak kami kita berpuas hati dengan penjelasan yang dibuat Arul khusus pelan rasionalisasi yang telah dicadang beliau bagi mengatasi kemelut berlaku dalam 1MDB,” kata Tuan Ibrahim pada sidang media selepas sidang tersebut.

Syarikat kerajaan Abu Dhabi, International Petroleum Investment Company (IPIC) pada 1 Ogos memberikan masa 5 hari bekerja kepada 1MDB untuk melangsaikan hutang AS$603 juta (kira-kira RM2.58 bilion) yang gagal dibayar pada 31 Julai.
1MDB dalam kenyataan berkata mereka komited untuk memenuhi obligasi kepada IPIC pada Ogos nanti, tanpa memberikan tarikh khusus.

1MDB berkata semua bayaran kepada IPIC akan dibuat menerusi pelan rasionalisasi 1DMB, di mana ia akan menjual aset. Menurut 1MDB, kelewatan membayar hutang disebabkan perlu mendapatkan “kelulusan kawalan selia”.

Di sidang media hari ini, Tuan Ibrahim berharap 1MDB diberi peluang untuk menyelesaikan hutang kerana kelewatan menyebabkan kos faedah yang besar iaitu AS$1.9 bilion setahun.

Tuan Ibrahim memberitahu pemberita Arul Kanda turut menunjukkan laporan Jawatankuasa Kira-Kira Wang Negara (PAC) mengenai 1MDB kepada mereka.
“PAC tak boleh selesaikan masalah sebab dianggotai 8 ahli Parlimen BN dan 5 ahli Parlimen pembangkang, dan tindakan belum ada.”

Tuan Ibrahim mengulangi gesaan mewujudkan Suruhanjaya Siasatan Diraja (RCI) untuk melihat isu 1MDB, khususnya sebelum Arul Kanda dibawa masuk ke dana milik kerajaan itu.

“Cadangan tersebut telah dikemukakan presiden (Datuk Seri Abdul Hadi Awang) pada 13 Oktober 2015. Saya fikir paling awal cetuskan idea RCI diwujudkan dalam isu 1MDB,” tambahnya.

“Kita harap tak banyak campur tangan politik sebab sudah ada pelan telah dikemukakan beliau (Arul).”

Arul Kanda tidak turut serta dalam sidang media PAS dan tidak mahu memberi sebarang ulasan kepada media.

PELANTIKAN SAYA BERPERLEMBAGAAN - KETUA HAKIM NEGARA





Ketua Hakim Negara, Tan Sri Md. Raus Sharif berkata, pelantikan beliau ke jawatan tersebut bermula semalam adalah berperlembagaan kerana prosedurnya mengikut undang-undang.

Beliau memberi jaminan akan menjalankan tugas yang diamanah kan sepanjang tiga tahun pelantikan tersebut.

Md. Raus memberi reaksi pertamanya ketika mengulas isu pelantikan beliau yang menimbulkan kontroversi sehingga menyebabkan Badan Peguam Malaysia mengadakan Mesyuarat Agung Luar Biasa (EGM), Khamis lalu.

Badan Peguam meluluskan usul bahawa pelantikan beliau dan Presiden Mahkamah Rayuan, Tan Sri Zulkefli Ahmad Makinudin adalah tidak berperlembagaan.

Presidennya, George Varghese berkata, badan itu berpendirian untuk mengemukakan tindakan undang-undang bagi mencabar pelantikan tersebut dalam tempoh terdekat. – UTUSAN ONLINE.



Sementara itu mengikut seorang pensyarah undang-undang yang merupakan bekas ahli Dap, mengkritik usul yang dikemukan oleh Badan Peguam tersebut kerana daripada 17752 peguam yang berdaftar hanya 993 ahli yang hadir dan mengundi usul tersebut.

“PERKEMBANGAN POSITIF KES SAMAN SARAWAK REPORT DI LONDON”




Pada Rabu 2 Ogos 2017, pasukan peguam dari firma Carter-Ruck dan barrister Jacob Dean, yang mewakili Dato' Seri Tuan Guru Abdul Hadi Awang (TGHA) dalam saman fitnah yang diambil terhadap Clare Rewcastle Brown (CRB), di London Courts, telah menghadiri prosiding mahkamah untuk pendengaran prosiding pengurusan kes.

Saman sivil oleh TGHA itu adalah berkaitan dengan artikel yang ditulis oleh CRB pada Ogos 2016, yang memberi gambaran tuduhan dan difahami dengan jelas adalah satu fitnah, melalui tuduhan bahawa TGHA menerima rasuah dari Perdana Menteri Malaysia Dato' Seri Najib dengan nilaiannya RM 90 juta.

Pendengaran pengurusan kes pada hari berkenaan adalah untuk menentukan usaha CRB bagi memaksa TGHA untuk mendepositkan sejumlah wang di mahkamah sebagai jaminan keselamatan, sekiranya TGHA kalah dalam kes berkenaan dan terpaksa membayar  kos guaman CRB, di mana CRB menjangkanya dalam lingkungan jumlah keseluruhan £800,000 pound (hampir RM4.5 juta) sehingga kes tamat.

Panel peguam TGHA dari Carter-Ruck berjaya berhujah, dengan dibantu oleh pandangan pakar undang-undang dari Malaysia, bahawa sebenarnya wujud undang-undang yang jelas yang tidak menghalang CRB untuk menuntut kos beliau menerusi mahkamah Malaysia sekiranya beliau menang kes saman ini dan jumlahnya tidak melebihi RM80,000 sahaja. Di atas keyakinan dari awal terhadap kes ini, maka TGHA bersetuju dengan deposit keselamatan dengan jumlah ini yang nyata adalah memadai serta tidak kontroversi.

Hujah CRB bahawa beliau akan gagal membawa kes saman terhadap TGHA di Malaysia adalah kerana Badan Kehakiman, Kerajaan Malaysia dan Perdana Menteri adalah mengamalkan rasuah dan bersekongkol dengan TGHA telah ditolak oleh mahkamah di London. Mahkamah juga mendapati bahawa tuduhan serius ini tidak disokong bukti oleh CRB walaupun beliau mempunyai masa berbulan-bulan untuk berbuat demikian.

Mahkamah juga tidak menerima hujahan CRB tanpa membawa bukti, bahawa sebuah negara luar berdaulat yang mempunyai hubungan diplomatik yang baik dengan United Kingdom telah mengamalkan rasuah.

Mahkamah juga telah menerima tawaran TGHA untuk meletakkan wang sebanyak RM80,000 sebagai deposit keselamatan.

Hasil dari hujah kosong dalam permohonan CRB, mahkamah juga telah mengarahkan beliau membayar 2/3 (dua pertiga) dari kos yang terlibat. CRB mesti membayar £15,000 ( hampir RM84,000) terhadap kos prosiding oleh TGHA, di mana kuantum pembayarannya akan di pantau oleh mahkamah.

Mahkamah juga mengarahkan CRB untuk membuat pembelaan beliau dalam tempoh 21 hari supaya kes ini dapat diteruskan dan beliau tidak lagi berlarutan untuk berdolak dalih.

Permohonan rayuan CRB terhadap keputusan ini juga telah tidak dbenarkan oleh mahkamah.

Perkembangan ini adalah sangat positif, dalam proses TGHA untuk membersihkan nama beliau terhadap tuduhan fitnah melampau oleh CRB dan artikelnya dalam Sarawak Report.

TGHA mengucapkan tahniah dan penghargaan kepada Mr Adam Tudor dan pasukan peguamnya dari Carter-Ruck, London dan di Malaysia.

TGHA juga mengucapkan jutaan terima kasih pada semua ahli PAS dan orang awam  yang berterusan memberikan sokongan melalui berbagai cara dalam kes ini.

TGHA juga sebenarnya dimaklumkan oleh firma Carter-Ruck bahawa Pejabat Pesuruhjaya Tinggi Malaysia di London juga menghantar wakil dalam prosiding ini, dan telah memaklumkan bahawa kehadiran mereka adalah sebagai pemerhati prosiding kerana banyak tuduhan politik yang dibuat terhadap Perdana Menteri dan Kerajaan Malaysia serta Badan Kehakiman di Malaysia  oleh CRB dalam dokumen  beliau yang dikemukakan ke mahkamah.

"CIVIL SUIT AGAINST CLARE REWCASTLE BROWN (SARAWAK REPORT)"

On 2nd August 2017, the lawyers from the legal firm of Carter-Ruck and barrister Jacob Dean, who are representing Dato Seri Tuan Guru Abdul Hadi Awang (TGHA) for the civil suit that he brought against Clare Rewcastle Brown (CRB), in the London Courts, attended court in London for the Case Management hearing.

The civil suit was in relation to an article she wrote in August 2016, which would clearly have been understood to allege, falsely, that TGHA had received bribes from Prime Minister Najib to the tune of RM90 million.

This case management hearing was to determine an attempt by CRB to force TGHA to deposit money with the court as security, in the event he was to lose the case and would have to pay CRB’s legal costs, which she estimates to be around £800,000 (or close to RM5 million) in total for the whole hearing till completion.

Carter-Ruck successfully argued, assisted by a legal opinion from a law expert in Malaysia, that there exist well-established laws between the UK and Malaysia that allows for CRB to claim the costs through the law courts in Malaysia, incurring a cost of not more than RM80,000.  Based on his confidence on the case from the beginning, TGHA had already offered to deposit this amount with the court, which was sufficient and uncontroversial.

CRB’s arguments that she cannot successfully bring a legal suit against TGHA in Malaysia as the judiciary, government and the Prime Minister are corrupted and are complicit with him was rejected by the court.  As the court observed, these serious allegations were not supported by any evidence from CRB whatsoever, despite having months to provide some.

The Court made very clear that, absent with any evidence, the court cannot accept that another sovereign state that has good ties and relationship with the UK is corrupt.

The court accepted the offer by TGHA to pay the RM80,000 deposit.

In recognition of the flawed basis of her application, CRB was ordered to pay TGHA two thirds of his costs of the exercise.  She has to pay £15,000 to TGHA now, with the quantum of the balance to be assessed by the Court in due course.

The court also ordered CRB to submit her defence into court within 21 days so that TGHA can proceed with this case and she cannot continue to prevaricate.

A request to appeal this judgment by CRB’s lawyers was disallowed by the court.

This is a very positive development for TGHA in his bid to clear his name of the allegations by CRB and Sarawak Report in their article.

TGHA would like to extend his congratulations, gratitude and appreciation to Adam Tudor and his legal team at Carter-Ruck, London and in Malaysia.

TGHA also would like to extend his gratitude to members of PAS and the members of public who have been supporting him in this very difficult case.

TGHA was also informed by Carter-Ruck that the Malaysian High Commission in London sent representatives to attend, who informed Carter-Ruck that they are there to observe the proceedings as many political allegations were made against the Prime Minister of Malaysia, the government of Malaysia and the judiciary in Malaysia by CRB in documents that she is filing into court.

Tun Abdul Razak - The Hidden Story


First, you tried to damage his reputation, then his wife, then his father, then his children, and when that all failed, you're targeting his father again. When you tried to damage the rest, I don't care. That's not my problem but his. But when you tried to damage his father's, I care. 

Yes, I'm talking about our PM, DS Najib Tun Razak. I don't care if you all spread lies about him or his family, because they have yet to prove themselves in my eyes. But when you try to spread half-truths about Tun Abdul Razak, that I can't accept.



What Half-truths? 
 
Look at this photo. This is a photo of young Tun Abdul Razak when he joined Malayan Civil Service, then subjugated under Japanese Imperial Army. With this photo, you are trying to imply that the young Tun Abdul Razak as ass-kissers whose scared of death and willingly accepted foreign subjugation. 

Tun Abdul Razak in Japanese Military uniform. If it was true he was a traitor, he would have ensured this part of history be hidden forever when he was the PM.
Yes, the photo is not manipulated. You can find this photo in many period books, discussing of the era. If this photo is so damaging, why did not Tun Abdul Razak have it destroyed when he was the PM? For the truth of his involvement is far more patriotic than even you or me can be.
 
Enter Young Abdul 'Cloak-and-Dagger' Razak
 
Second World War came when young Abdul Razak was studying in Singapore at Stamford Raffles College. With his study disrupted, he was called to return to Kuantan.
 
The war was not kind. He saw many atrocities made in the name of patriotism. He had probably too came across victims or next-of-kins of Sook Ching massacre.
 
By the time he reached Kuantan, news of young men being grabbed to be forced labour to Siam has probably reached Kuantan.
 
In the Malayan Civil Service, Abdul Razak met up with Yeop Mahidin Bin Mohamad Shariff. Yeop Mahidin was a civil servant, a magistrate to be exact. He had wanted to serve his country, but his headmaster denied him his dream to join Malay Regiment. 
 
When the war broke out, Yeop Mahidin was quick to form a resistance force he named as Askar Wataniah Pahang. The unit was formed with His Majesty Sultan Abu Bakar's consent. 
 
In Force 136 colours
Seeing Abdul Razak's enthusiasm to serve his country, Yeop Mahidin took him under his tutelage, and instructed him to join the Malayan Civil Service to be eyes and ears for the Wataniah.

In Malayan Civil Service
 
Young Abdul Razak was posted back to Pahang by the Japanese administration. His impeccable character made them looking up to him and appointed him as an assistant at the  District Officer.
 
While in the jungles of Pahang, Yeop Mahidin had secretly managed to recruit more than 200 Malay for resistance force (his identity as founder of Wataniah was not known by his men as he operated via proxy).
 
They were not able to get much help as Force 136 had initially distrusted them; the action of Ibrahim Yaacob and several members of Kesatuan Melayu Muda in helping Japanese forces in Malaya had caused the British to distrust Malays. So serious was the distrust that after Sook Ching Incident, Japanese Administration had actually leaned towards favouring Chinese. One of the first act by the Japanese was to split out Kedah, Kelantan, Terengganu, and Perlis from Malaya and transferred the ownership to Siam as a reward to Siam for allowing Japanese forces to land in Singgora.
 
As an Assistant District Officer, Abdul Razak had to coordinate a lot of activities with the Japanese Imperial forces. He made friends with several of them.
 
In the mean time, the Wataniah forces viewed Abdul Razak as a traitor as he was working with the Japanese.
 
Wataniah as Part of Force 136
 
Wataniah was finally part of the fold of Force 136 when the British began sufficiently trust Malays to fight the Japanese. This was probably due to the fact British realised that whether they like it or not, more than half of Malaya's population were Malay.

When Wataniah's resistance activities began to bite the Japanese Occupation force, they began to suspect the ranks of Malayan Civil Service who had handled details of Japanese Forces movement. In one of the attacks done by Wataniah, a 20-men squad was able to ambush and killed 30 Japanese soldiers.
 
One of the Japanese soldiers was a friend to Yeop Mahidin, who was then at his post as a Magistrate. Not wanting Yeop Mahidin to be arrested (he did not know that Yeop Mahidin was the head of Wataniah), he told Yeop Mahidin to be careful of Abdul Razak. 
 
Yeop Mahidin quickly set out a plan (probably via Ghazali Shafie, future Malaysian Foreign Minister) that involved having Abdul Razak to be 'kidnapped' by Wataniah, ostensibly to have him executed. 
 
The 'kidnapping' rouse was a success, as the Wataniah men did not know Abdul Razak was their agent and their mission was a rescue mission. It was only when Abdul Razak exited the Commandant's camp they realised he was one of theirs. 
 

Rescue of Sultan Abu Bakar
 
Rumours of Japanese surrender began to spread. MPAJA's activities began to be active and Wataniah had received rumours that MPAJA was planning to kidnap the Sultan. 
 
When Abdul Razak and his team arrived to collect the Sultan, his men found leaflets left by the Japanese proclaiming that Chinese murderers had killed the Sultan. Though seething with anger, he instructed his men to collect and destroy all the leaflets. His action had probably saved the Chinese of Kuantan from being summarily executed by Malays who were angered to the loss of their Sultan. 
 
The Sultan was later found to be safe and sound. Abdul Razak had not only saved the Sultan, but also stopped Malays from falling into Japanese forces' divide and conquer tricks.


Tun Razak's Exploit - Far Braver than you or me
 
Being a soldier fighting for your homeland is one thing. But being a spy in your own country that had been occupied by the enemy and working with the enemy so you can get critical information back for your people, that's bravery.


If you, the keyboard warriors who had never faced any danger other than having a paper cut on the finger, try to defame him so people will hate his son, you are one sick person.
 

PS: I've seen many people claiming the Govt hide the true history so they can portray themselves favourably. The truth is, there's too many things in history to be fit into our syllabus. This for example is one.
